Remember this?
The US Supreme Court has ordered Obama to submit his birth certificate by December 1st for review. -- Jaycee
And this?
If those challenging the citizenship are just crazed conspiracy theorists, why is the Supreme Court paying any attention to them? A response is due Dec. 1 and a hearing is scheduled for Dec. 5. It seems that at this point Obama would just send a copy of his birth certificate to the Supreme Court to settle the issue, but it seems like he would have done that a long time ago. -- Rhinoceros Times Editor, John Hammer
So, did Obama obey the order to turn over his birth certificate by December 1st and how did that hearing go? (If you prefer to answer the answerable, you might try "Was there ever an order for Obama to turn over his birth certificate and was there ever a hearing scheduled?")
The "hearing" was held in "conference." This isn't the same thing as what I believe you're referring to in the post. The SCOTUS justice whose district this is apparently turned down hearing the case and Justice Clarence Thomas brought it to "conference." There is some indication Thomas may have done that in order to end the suit once and for all, but there is a lot of speculation as to why he took this unusual step (after the first justice turned it down). Usually, SCOTUS justices follow what the others do.
ReplyDeleteConsequently, whether or not they'll take up the case isn't reported in the same manner as cases that are brought for review under a different system (I'll stick a link below because I will fail miserably at nomenclature) that we're more familiar with and is reported publicly.
The case is Donofrio v Wells and you can see these links for more info. The AFRO link was particularly good.

Hope that helps.
Yes indeed. There was no hearing; there was no deadline for Obama to turn over his birth certificate; and while the Supreme Court did meet to consider whether to hear the Donofrio case, that case does not challenge that Obama was born in Hawaii or ask for any action regarding his birth certificate.
ReplyDeleteSeems the Supreme Court is waiting to hear from me before issuing a decision on Donofrio, so here goes: While the Court is more than loathe to enter this dispute, currently it has no choice (thanks to the audacious one — and I don’t mean Leo, I mean Barack) and the ONLY WAY to bring closure, knowing CLOSURE IS ABSOLUTELY ESSENTIAL before any Presidential inauguration, is to back the original intent of the Constitution, meaning, Obama is NOT an Article II “natural born citizen” (albeit Obama may or may not be a “citizen”, a question heated by the steadfast refusal of the DNC or any of the Secretaries of State to require his birth certificate, which the Court will now not have to confront).
ReplyDeleteTed, no closure is needed because the facts are not in dispute. Obama was born in Hawaii and is therefore a natural born citizen. End of story.
ReplyDeleteThe Supreme Court doesn't decide basic facts, they decide legal matters. This issue is dead, dead, dead.
